The Last Will and Testament of Francis Cockerill, Gentleman of Huntingdon ((1))

This is the Last Will
and testament of me Francis Cockerill of the Town of
Huntingdon in the county of Huntingdon Gentleman
made this fourteenth day of February in the year of
our Lord One thousand Seven hundred and Eighty five
as follows First I give and devise All and Singular
my Messuages Lands tenements and Real Estates
whatsoever and wheresoever whether Freehold Copyhold
or charterhold or of what nature Tenure or kind
soever the same consists with these and every of these
Appurtenances unto my son Robert Cockerill and my
Daughter Mary the wife of Robert Craxford and
the survivor of them and the heirs and assigns
of such survivor in trust that they do and shall
as soon as conveniently may be after my decease
sell and dispose thereof for the best price or prices
that can be got for the same and the Money therefrom
arising shall and do retain pay and divide to and
amongst all my children (that is to say) the
said Robert Cockerill my son John Cockerill my son
Alice the wife of Thomas Jarvis my daughter and
my said daughter Mary the wife of Robert Craxford
in equal proportions share and share alike if they
my said children shall then be living and if any of
them shall depart this life in my life time or before the
said Sale shall take place then the part or share
parts or shares of him her or them so dying shall
go and be paid to his or their Legal Representatives
And in the mean time and until such Sale shall take
effect I will and direct that the Rents Issues and
Profits of the said premises shall go and be divided
amongst my said Children in the proportions aforesaid
And I expressly will and declare that the Receipt or
Receipts of my said Trustees or the Survivor of them
his Heirs or Assigns shall be a good and sufficient
discharge to the Purchaser or Purchasers of my said

Real Estates
for the several sums of Money to be by them the said
purchasers respectively paid to my said Trustees and that
after such Receipt or Receipts so given such Purchaser
or Purchasers shall not be obliged to see to or be
any ways affected by the misapplication or inapplication
thereof Also all and singular my Household Goods and
Household Furniture Plate Linen and China I give and
bequeath unto my said daughter Mary the wife of
Robert Craxford for her own sole and absolute use and
benefit Also all my ready Monies debts and securities
for Money and Also all the rest residue and remainder
of my Personal Estate whatsoever and wheresoever and
of what nature or kind soever the same may consist at
the time of my decease I give and bequeath the same
and every Part thereof unto my said Son Robert
Cockerill and my said Daughter Mary the wife of the
said Robert Craxford and the Survivor of them and
the Executors and Administrators of such Survivor In
Trust that they shall and do as soon as conveniently
may be after my decease sell and dispose of such part
thereof as do not consist of Monies or Securities for
(and shall do call and get in such parts thereof as consist of Monies or Securities for Money)
Monies ^ and the monies therefrom arising shall and do
retain pay and divide to and amongst all my said
Children the said Robert Cockerill John Cockerill Alice

the Wife of Thomas Jarvis and Mary the wife of Robert
Craxford in equal proportions share and share alike
if they my said children shall be then living and if
any of them shall depart this life in my life time or
before the said Sale and division shall take place
then I will and direct that the Part or Share parts
or Shares of him her or them so living shall go
and be paid to his her or their Legal Representatives
And whereas I have at different times advanced
my Son In Law Thomas Jarvis the Sum of three
thousand three hundred and forty one pounds and
Eleven shillings now my will is that the said Sum of
three thousand three hundred and forty one pounds
and eleven shillings should be deducted out of my said
daughter Alice's share of the Monies arising from
the Sale of my said Real and Personal Estates and
I do hereby impower and order my Executors
hereafter named to deduct the same accordingly but
my Will is that if it should happen that my daur
Alice's share of the Monies arising from the sale of
my Real and Personal Estates should not amount
to the sum of three thousand three hundred and
forty one pounds and Eleven shillings then that my
said Executors should give the said Thomas Jarvis
a Receipt in full for all Debts due to me from him
And whereas others of my said Children have had
divers Sums of Money for which they have given
me Security Receipts or Memorandums my will is
that Such Sums of Money as they have already
had and such as they may hereafter have from me
in my life time and give me Securities Memorandums
or Receipts for shall be taken and considered as so
with Money by them xxx in part of his her
or their Share of the Monies arising by the Sale
of my Real and personal Estate aforesaid and
Lastly my will is and I do hereby expressly declare
that my said Trustees or either of them their or either
of their Heirs Executors or Administrators shall not be
charged or chargeable with or accountable for any
more of the said Trust Estate Monies and premises than
they shall actually receive or shall come to their respective
Hands by virtue of this my will or for any loss which
shall or may happen of the same provided such loss
shall happen without his her or their wilful consent
or default and that it shall and may be lawful for
them by and out of the said Trust Monies and
Premises to deduct and reimburse themselves respectively
All such Costs Charges and Expenses as they or either
of them shall sustain expend or be put unto in through
or by the Performance of the Trusts hereby on them
reposed or in the management or Execution thereof
or in any wise relating hereto and I do hereby
appoint my said son Robert Cockerill and my said
daughter Mary the wife of the said Robert Craxford
joint Executors and Executrix of this my will hereby
revoking all former wills by me made and declaring
this only to be my last will In witness whereof
I the said Francis Cockerill have hereunto set my
Hand and Seal this day and year first above written
The Mark + of Francis Cockerill Signed Sealed and Published
and Declared by the said Francis Cockerill as and for
his last will and Testament in the presence of us
who in his presence at his request and in the
presence of each other have subscribed Our Names as
Witness thereto Arthur Ashton Henry Sweeting Eliz. Craxford

This Will was proved at London the tenth
day of January in the year of our Lord One thousand
Seven hundred and Eighty Eight before the Right Worshipful
Commissary of the Prerogative Court of Canterbury
lawfully constituted by the oaths of Robert Cockerill
the son and Mary Craxford (wife of Robert Craxford)
the daughter of the deceased the Executors named in the
said will to whom Administration was granted of
all and singular the Goods Chattles and Credits of the
said deceased having been first sworn by commission
duly to administer
